Court’s Directive to Authorities
Justice Jasmeet Singh, presiding over a single-judge bench, has instructed various authorities, including the Delhi Development Authority and the National Highways Authority of India, to provide a timeframe for the de-concretisation of trees in the national capital.
Observations of the Court
During the hearing, Justice Singh emphasized that the ultimate objective is the de-concretisation of trees throughout Delhi. The court requested detailed affidavits, specifying the location of the trees, and mandated verification by the Deputy Conservator of Forests.
Affidavit Details
Justice Singh highlighted that the submitted affidavits should not only explain why a certain number of trees have been de-concretised but also include a clear timeframe for the de-concretisation of the remaining trees.
Implementation after Restrictions
The court expressed the intent to initiate de-concretisation immediately after any restrictions imposed by the Delhi government, taking into account the Graded Response Action Plan (GRAP) 3 restrictions on construction and demolition activities.
