High Court Upholds Verdict
The Delhi High Court, on December 12, 2023, upheld the trial court’s decision to deny Omar Abdullah’s plea for divorce. A bench comprising Justices Sanjeev Sachdeva and Vikas Mahajan stated that there was no merit in Abdullah’s appeal.
Allegations of Cruelty
Abdullah had sought a divorce on the grounds of cruelty, claiming mistreatment by his estranged wife. However, the high court found no infirmity in the trial court’s view that the allegations of cruelty were vague and unacceptable.
Court’s Judgment
The bench, in its judgment, emphasized that Abdullah failed to prove any act, whether physical or mental, that could be termed as an act of cruelty toward him. The trial court had previously ruled that Abdullah could not substantiate his claims of “cruelty” or “desertion,” the grounds he had alleged for the divorce decree.
Omar Abdullah’s plea for divorce from his estranged wife has been dismissed by both the trial court and the Delhi High Court, with the latter upholding the earlier verdict. The legal process has determined that Abdullah could not sufficiently demonstrate the grounds for divorce as per his claims.
