Minister of State (IT) Rajeev Chandrasekhar recently announced that the Ministry of Electronics and Information Technology (MeitY) is in the process of developing a sustainable and permissible framework for online gaming. The aim is to establish a comprehensive regulatory framework that ensures responsible and sustainable online gaming practices. Once this framework is established, MeitY plans to approach the GST Council to reconsider the decision of imposing a 28% tax on online gaming.
Importance of a Comprehensive Regulatory Framework

Chandrasekhar emphasized the need to prioritize the development of a sustainable online gaming framework before addressing taxation concerns. The early stages of the framework’s development are currently underway, and Chandrasekhar stated that once it is finalized, they will approach the GST Council with the new regulatory guidelines. The objective is to ensure that the regulatory framework is well-defined and comprehensive, taking into account the evolving nature of online gaming and the concerns of all stakeholders involved.
Distinction between GST Council and Government of India
Chandrasekhar clarified the distinction between the GST Council and the Government of India. The GST Council operates as a federal organization representing all state governments, and its decision to impose a 28% tax on online gaming companies, horse racing, and casinos was the result of three years of collective effort. On the other hand, the process of formulating the online gaming regulatory framework began in January 2023. It is important to note that the decision made by the GST Council was separate from the ongoing efforts to establish a sustainable framework for online gaming.
Cautious Approach to Developing Regulations
Acknowledging the discontent within the online gaming industry regarding the GST Council’s decision, Chandrasekhar advocated for a cautious approach to developing regulations. He stressed the significance of creating sustainable frameworks through careful consideration, rather than hastily reacting to industry or startup grievances. The objective is to avoid unintended consequences and ensure that the regulatory framework aligns with the long-term vision of the digital space. Chandrasekhar emphasized that laws and rules in the digital domain should undergo detailed consultation with stakeholders, allowing for a comprehensive understanding of the industry’s needs and challenges.
By taking the time to develop a robust and sustainable framework, the Ministry of Electronics and Information Technology aims to strike a balance between promoting responsible online gaming practices and addressing taxation concerns. The focus is on creating an environment that supports the growth and development of the online gaming industry while safeguarding the interests of all stakeholders involved.
