Three High Court Judges Transferred After Supreme Court Collegium Rejection

Union Law Minister Arjun Ram Meghwal announced the transfer of three High Court (HC) judges, namely Dinesh Kumar Singh, Manoj Bajaj, and Gaurang Kanth, to different High Courts. This decision came after their request for a choice posting was rejected. The transfer was made by the President of India in consultation with the Chief Justice of India, exercising the power conferred by the Constitution of India.

Details of the Transfers

  • Justice Dinesh Kumar Singh of the Allahabad High Court was transferred to the Kerala High Court.
  • Justice Manoj Bajaj of the Punjab and Haryana High Court was posted to the Allahabad High Court.
  • Justice Gaurang Kanth of the Delhi High Court was transferred to the Calcutta High Court.

These transfers were carried out by the collegium headed by Chief Justice of India D Y Chandrachud.

Reiteration of Recommendations Despite Representations

On July 12, the Supreme Court collegium reiterated its recommendations for transferring all three judges, even though they had made representations for a choice posting. Justice Gaurang Kanth had requested his transfer to the Madhya Pradesh or Rajasthan High Court or a court in any neighboring state. However, the collegium, after careful consideration, did not find any merit in Justice Kanth’s request.

Recommendations for Better Administration of Justice

In a separate decision, the collegium reiterated its recommendation to transfer Justice Dinesh Kumar Singh from the Allahabad High Court to the Kerala High Court for better administration of justice. Justice Singh had requested his transfer to nearby states such as the high courts of Delhi, Punjab & Haryana, Madhya Pradesh, or Rajasthan. However, the collegium did not find any merit in his request.
